WAL-MART Reaches New Lows in Treatment of Innocent Victims

For years we have discussed how mega-retailer WAL-MART mistreats its own employees, and fights almost every injured customer’s claims all the way to trial, no matter how obviously the company was at fault. WAL-MART has law firms on retainer in nearly every city and hamlet in the country. Truth be told, they really “lawyer up.”

I guess it should have come to no surprise that now WAL-MART has taken the position in Court filings that comedian and actor Tracy Morgan‘s injuries were “caused, in whole or in part, by plaintiffs’ failure to properly wear an appropriate available seat belt restraint device,” and that Morgan and company had “acted unreasonably and in disregard of (their) own best interests.” UNBELIEVABLE – if it was not WAL-MART’s legal team making the ridiculous argument.

Police reports indicate that the WAL-MART truck driven by employee Kevin Roper rear-ended the limousine in which Morgan and comedian James McNair were riding.  McNair was killed in the wreck. Morgan was critically injured in the wreck, suffering a broken leg, broken ribs and a broken nose. Police reports say the truck was traveling 20 mph over the posted speed limit on the New Jersey Turnpike. Court documents revealed that the WAL-Mart driver had been awake for more than 24 hours at the time of the crash.

Roper has been charged with vehicular homicide and assault by automobile and has pleaded not guilty.

Yet it appears WAL-MART asserts that the driver was not at fault and that the limousine occupants were the culprits. Having had several successful cases against WAL-MART, we at the Wininger Law Firm are not surprised that the mega-corporation has chosen to attack the innocent victims in this matter. They are notorious for these tactics. But this accusation is nothing less than SHAMEFUL and EMBARASSING for the huge corporation. How do they sleep at night?
