The Consequences of Tailgating and Aggressive Driving in Alabama

The National Highway Traffic Safety Administration (NHTSA) finds that approximately one-fourth of all injury accidents in the United States are caused by rear-end collisions. The NHTSA recommends a three-second “safety cushion” of time between vehicles to prevent rear-end crashes from occurring.

A driver may tailgate because he is unable to perceive the dangers of following too closely in relation to the speed he is traveling, or because he is using aggressive tactics to intimidate the driver in front of him.

Alabama law states that a driver of a motor vehicle “shall not follow another more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway.” Except when overtaking or passing another vehicle, the law states that a driver must leave a distance of 20 feet or more for each 10 m.p.h. of speed between his car and the car behind him.
